On or about Nov. 2, 2010, plaintiff says he went to VCU Health Systems for medical complaints relating to an auto accident earlier in the evening. After being seen by an emergency room physician, he was discharged about 6 a.m. and advised to get something to eat. While he was waiting in the hospital lobby for the Chick-Fil-A to open at 7 a.m., plaintiff says he fell asleep on a bench, and was awakened by three VCU police officers and told to leave. Plaintiff says he produced documentation that he was a patient of the hospital, and headed for the restaurant. As he was leaving the restaurant, he was arrested for trespassing and forcibly handcuffed. He was subsequently found not guilty, and seeks judgment of $500,000, plus costs and fees.
