Alan Delforn v. Loan Depot.com LLC
Plaintiff says defendant solicited him in November 2011 through phone calls, email and Internet contact to secure financing and/or refinancing through them, offering a lower interest rate and a substantial savings on his mortgage. Plaintiff, who says he has sterling credit, says he submitted cash payments, volumes of financial information and confidential information to Loan Depot as instructed. Defendant repeatedly informed plaintiff he was approved, plaintiff says. Plaintiff says representations made by defendant were false, fraudulent and calculated to extract additional efforts and monies from him without closing the loan. In February 2012, defendant reversed its position and denied plaintiff approval. Plaintiff alleges breach of contract, fraud and deceit, and says he has suffered out-of-pocket expenses, disclosure of confidential information, fees and costs. Plaintiff seeks judgment of $50,000 plus all exemplary damages of $25,000.
