Plaintiff says Palla, a security guard, confronted him outside his apartment while he was grilling food following a power outage, told him to stop grilling and to go inside. When plaintiff declined, defendant said he would “make him.” Plaintiff’s fiancée witnessed the confrontation, and when she protested, defendant pepper-sprayed her in the face, plaintiff says. Plaintiff says while providing assistance to her, defendant began beating him with a baton. He got up to leave the scene and call police when defendant drew his firearm, plaintiff says, followed him into his apartment and attempted to handcuff him. When police arrived, defendant procured plaintiff’s arrest and he was transported to Richmond City Jail, first stopping at Medical College of Virginia for treatment. Plaintiff says he was imprisoned for two days before a bond hearing, that the charge was nolle prosequi, and that defendant ultimately pleaded guilty to unlawful obstruction of justice by force. Plaintiff alleges assault, battery, unlawful arrest and malicious prosecution and seeks compensatory damages of $10 million and punitive damages of $5 million.
