Carol Shraison v. RTJ Properties of Virginia, LLC and Robert M. Tuck
Plaintiff, 74, says while impaired from a stroke, her longtime attorney Tuck advised her to obtain a reverse mortgage on her home at 1813 Maple Shade Lane to pay off outstanding debts and to have defendant company purchase her home, without suggesting she discharge debts in bankruptcy or advise her that her mortgage might also be dischargeable, or to advise her to consult another attorney prior to executing the sale in order to avoid a conflict of interest. Plaintiff says Tuck was the agent for RTJ, and that she was intentionally deceived at closing as Tuck never intended to and did not prepare and execute documents that conveyed a life estate, never paid money due at closing, and never transferred the mortgage out of her name, and that to avoid eviction, she has been paying “rent” to Tuck for a property obtained illegally. Plaintiff alleges fraud, breach of contract and undue influence, and seeks an order restoring title to the home to her and compensation of $200,000.
