After the valuation, plaintiff says, Blair executed a series of actions against her, including using false claims to threaten a lawsuit against her unless she agreed to sell her ownership to him for a drastically reduced price and falsely accusing her of misconduct, and wrongfully terminated her employment with AEC. Plaintiff alleges breach of contract and tortious interference and asks that the court appoint a liquidation trustee and award damages of $30 million.

Plaintiffs say the Act of 1832 incorporating the James River and Kanawha Companies imposed a legal obligation upon the James River and Kanawha Companies to maintain the canal and its bridges, that defendant CSX is the successor, so it must maintain the bridge in good working order. Plaintiffs ask the court to order CSX and its successors to repair/replace the bridge to correct a public nuisance and say Sauer has incurred fees and expenses to maintain the bridge himself. They also seek damages of $2.5 million.
