Plaintiffs, children of decedent, say defendants, in charge of a “recovery house” and its programs, knew or should have known of Rice’s propensity for violence and failed to review his extensive criminal history before admitting him to the program and then promoting him to house manager within 30 days of arrival. Plaintiffs say Pulling was accepted in September 2021 and upon information and belief, all individuals in the house on Nov. 13, 2021, except Pulling, were using illegal drugs, but defendants did nothing to address the volatile situation. Plaintiff says upon information and belief, when Pulling was sleeping, Rice stole his credit cards after binding Pulling with restraints and gave one of his cards to another resident, telling the resident if he did not retrieve money from the ATM, Rice would kill the resident’s family. The resident called Young, who had become romantically involved with Rice, plaintiffs say, to report the situation and say Rice was going to kill Pulling, but Young did not take any measures, and while the resident was out, Rice beat and stabbed Pulling to death. Plaintiff alleges negligence and seeks judgment of $5 million, and punitive, $350,000.
