Lynsey Ann Porter v. Blue Ridge Bankshares, Inc. d/b/a Blue Ridge Bank; and G. William Beale, in his individual capacity
Plaintiff says she was hired on/about Jan. 1, 2023, to work as a deputy Bank Secrecy Act Officer and financial crimes manager, following the federal government’s findings of impropriety at the bank, including unsafe practices, failure to correct previously reported problems and violations and deficiencies in the Bank Secrecy Act, and during the course of her employment, reported frequent unlawful activities to her supervisors, but management dismissed or ignored her reports. On/about Jan. 1, 2024, the acting chief risk officer resigned, plaintiff says, and she was offered a retention bonus to stay, as were others, and seemingly given a promotion to a vice president of financial crimes customer risk manager, but soon learned that she had been stripped of discretion in day-to-day decision making, and her duties were transferred to her supervisor, who kept her in the dark as much as possible, and that the position was actually a demotion. In May 2024, plaintiff says, she again reported financial improprieties to her supervisor and management, and in July was informed the matters were investigated and a cause of action proposed, with no details, and the matter was closed. Plaintiff says her therapist advised her to leave because the work environment was unsafe, and she resigned Aug. 2, 2024, citing the retaliation she experienced after filing a formal whistleblower complaint. Plaintiff says she was then contacted to repay the $6,701.25 retention bonus, which was not requested of other employees who had resigned. Plaintiff alleges wrongful discharge, retaliation and discrimination, and seeks judgment of $10 million and reinstatement.
