Plaintiffs say a certificate of occupancy was issued Jan. 31, 2022, but as early as July 2023, multiple sprinkler systems and CPVC pipe failures occurred, resulting in localized flooding and damage to the building, necessitating extensive repairs, and in January 2024, an independent group determined the pipes failed due to contact with a certain kind of caulk known to be incompatible with CPVC pipe, and Atlantic embarked on a 7-month repair process. Plaintiffs say an inspection in August 2024 found CPVC-incompatible caulk throughout the system, necessitating a full replacement. Plaintiffs say defendants failed to correct defects and deficiencies and knowingly installed the systems in a defective condition, and seek judgment of $10 million.
